According to a Department of Labor’s DBA Claims Administration Status Report dated October 2008


A PTSD claim is presumed to compensible under the Act unless rebutted by substantial evidence

Fast Track PTSD cases through the dispute resolution process

ASSIST the parties to gather factual and medical evidence needed for claims resolution

Schedule informal conferences promptly on request

After Conference if OWCP claims examiners recommendations are rejected, refer the case promptly for hearing upon request.

    Yeah Right!! Someone needs to tell that to the DOL, CNA, and AIG

      They and their representatives, the defense attorneys, and many of our plaintiff’s attorneys were present at the DBA Conference where Miranda Chiu made this presentation.
      As you can see Miranda Chiu ,U.S. Dept. of Labor, Chief, Branch of Policy, Regulations and Procedures, DOL/ESA/OWCP/DLHWC is the name on this policy presentation/report. It remains posted on the DoL website.
      Miranda Chiu is currently acting Chief of the LHWCA.
      The DoL knows this, CNA knows this, AIG knows this, ACE knows this, the Defense Attorneys know it, and our attorneys know it.

      But you know what their only concerns right now are?
      Making sure companies file DBA Claims, pile em up, get them in the system and let the bodies fall where they may.

    DELAYED CLAIMS DECISIONS ADD TO THE STRESS AND ANXIETY OF THE CLAIMANT. NO KIDDING!! Thats true for all cases, not just PTSD. As a matter of fact! I’m sure it makes PTSD worse. And probably causes nearly the same effects in others, who lose their lives waiting for Ins. Co.s to pay what they owe.

    Since no one will stop these deadly crimes I filed a motion yesterday requesting a special prosecutor be appointed. Injured war zone contractors are mentioned in the motion. You can see it at

    My PTSD and other problems are being greatly increased by the fact that the DOL and DOJ are allowing the extreme destruction of so many lives in five different types of insurance (as you can see on the website if you click on my name)

    I had fluttering of both eyees yesterday from typing too much but this is a life or death matter for so many !!!!!
